General, Website Design, Lead Generation, etc.
Effective date: October 13, 2026
These terms apply when you buy the Website Launch Kit or the Shopify Store Launch from ZwanZ Marketing (“ZwanZ,” “we,” “us”). By completing checkout, you agree to them. If anything here conflicts with the General Website Design Terms further down this page, these terms apply instead.
• You pay a one-time build fee ($699 or $899, as shown at checkout) to have your site built and launched. Your domain for the first year and your first 30 days of hosting are included.
• After 30 days, hosting is $30/month, billed automatically until you cancel. Cancel anytime by email.
• We revise the design until you approve it, within your 4 pages.
• Your site stays live as long as hosting is active. If you cancel, it goes offline, and your domain stays yours.
• You give us accurate content you have the right to use. We can't guarantee results like sales or search rankings.
• Questions? Email zwanz@zwanz.com.
1.1 Website Launch Kit. A custom, mobile-friendly website of up to 4 pages (Home, About/Services, Contact, and one additional page such as a Product page), built from the information you give us in the intake form and launched on our hosting. It includes your domain for the first year (or the free connection of a domain you already own), a contact form, and links to your social profiles.
1.2 Shopify Store Launch. A custom Shopify storefront designed and launched for you, with your first 3 products uploaded. We build it in a Shopify development store and transfer it to your own Shopify account. Additional products and extra setup are quoted separately.
1.3 What's not included. Unless we agree otherwise in writing, these are not included: extra pages, online payments or booking software on the Website Launch Kit, SEO work, advertising, email marketing, photography, and ongoing management. We're happy to quote any of them.
2.1 Build fee. The build fee is the one-time price shown on the page you bought from and at checkout ($699 or $899), charged once at checkout. Applicable sales tax is calculated at checkout.
2.2 Hosting plan. Your first 30 days of hosting are free, starting at checkout. After that, hosting is $30 per month, charged automatically to the card you used at checkout until you cancel. For Shopify stores, the same terms apply to the maintenance plan included with your store (see section 4).
2.3 Domain. The first year is included. If your domain has a renewal cost after year one, it renews at the registrar's standard rate, and we'll let you know before it does.
2.4 Price changes. We may change the monthly price with at least 30 days' notice by email. You can cancel before the change takes effect.
2.5 Your Shopify plan. Shopify bills your Shopify subscription directly to you. It's separate from what you pay us.
2.6 Card disputes. If a charge looks wrong, please email us first. We'll work to fix it quickly.
3.1 Timeline. We build and launch your site within 3 days of receiving your completed intake form. The clock pauses while we're waiting on information, content, or approvals from you.
3.2 What we need from you. Accurate information, and content (text, photos, logos) that you have the right to use. You're responsible for making sure what appears on your site, including your services, prices, claims, and any required licenses or disclosures, is true and follows the laws that apply to your business.
3.3 Permission to use your content. You allow us to use your content to build, host, and maintain your site.
3.4 If we don't hear from you. If you don't respond to a request for more than 14 days, we may pause your project. If you're unresponsive for 60 days, we may close it. In that case the build fee isn't refunded once work has begun, but we'll cancel your hosting plan so you aren't billed for a site we haven't launched.
4.1 Revisions. We revise the design until you approve it. That covers changes to the look, layout, and wording within your 4 pages. Revisions are for getting your site right. Starting over with a new business, a new design direction after approval, or new content for the whole site counts as new work and is quoted separately.
4.2 Small edits after launch. While your hosting plan is active, it includes up to 3 small edits per month, such as updating text, swapping a photo, or changing prices or hours. We aim to complete them within 2 business days. Unused edits don't roll over. New pages, new sections, and redesigns are quoted separately.
4.3 Support. General questions about your site, your domain, or how things work are always welcome, even if you're not on a hosting plan. We can only edit sites that are live and hosted.
5.1 Hosting. We host your Website Launch Kit site on a third-party website platform. Hosting covers keeping your site online and secure on that platform. No online service is available 100% of the time, and we aren't responsible for outages or changes by our platform provider, though we'll work to restore your site quickly. We may move your site to a comparable platform if needed, and we'll tell you if it affects you.
5.2 Cancelling. You can cancel anytime by emailing zwanz@zwanz.com. We'll cancel within one business day, and you won't be charged again. Your site stays online through the end of your free first 30 days or the month you've already paid for, and then goes offline.
5.3 When hosting ends. Your site goes offline. Your domain stays registered in your name and remains yours. Because your site is built on a platform that doesn't let us move it elsewhere, the site itself can't be transferred, but on request we'll send you a copy of the text and images used on it.
5.4 Domain transfers. If you want to move your domain to another registrar, we'll help once your site has been active for 3 months.
5.5 Missed payments. If a hosting payment fails, we'll contact you. You have 7 days to fix it before your site goes offline. If it stays unpaid, we hold your site as-is for 30 days so you can pick it back up, and we'll put it back online if you pay what's owed in that time. After that, it may be removed.
5.6 Shopify stores. Your store lives in your own Shopify account, so cancelling your maintenance plan does not take it offline. You're responsible for your Shopify subscription, apps, and payment processing fees.
6.1 Before we start. If you ask for a refund before we receive your completed intake form, we'll refund your build fee in full.
6.2 After we start. Once we've begun work, the build fee is non-refundable because the work has been done, with two exceptions. First, if we haven't delivered your first draft within 7 days of receiving your completed intake form and the delay isn't caused by you, you can ask for a full refund. Second, if after good-faith revisions we can't produce a design you're willing to approve, contact us and we'll work out a fair resolution, which may include a partial or full refund.
6.3 Hosting and maintenance charges. We don't refund months that have already been billed, but cancelling stops all future charges. If you were charged in error, or billed for hosting without ever receiving a working site because of us, tell us within 30 days and we'll make it right.
6.4 Domains and third parties. Domain registrations and Shopify subscriptions are paid to third parties and aren't refundable by us.
6.5 How to ask. Email zwanz@zwanz.com. Approved refunds go back to your original payment method, usually within 5 to 10 business days.
7.1 Yours. You own your business name, brand, logo, and the text, photos, and other materials you give us.
7.2 What we create. Once your build fee is paid, you own the custom text and design we create specifically for your site. This excludes platform software, templates, stock images, fonts, and other third-party materials, which stay under their own licenses.
7.3 Ours. We keep ownership of our own tools, processes, templates, and know-how.
7.4 Third-party materials. You're responsible for having the rights to anything you provide. If someone claims your materials infringe their rights, you agree to cover the reasonable costs we incur because of that claim.
7.5 Portfolio. We may show your finished site and link to it in our portfolio and marketing unless you tell us in writing not to. We won't publish a testimonial from you without your permission.
Your site and checkout depend on services we don't control, such as our website platform, your domain registrar, Stripe for payments, Shopify for stores, and Google tools. Their own terms and policies apply, and we aren't responsible for their outages, changes, or fees. We're a Shopify Partner and may earn a commission when you subscribe to Shopify, at no extra cost to you.
Your site may not be used for anything illegal, deceptive, harmful, or abusive, including spam, fraud, or content that infringes someone else's rights. We may suspend or remove a site that breaks this rule, without refund, and we'll tell you why when we can.
10.1 No promised results. We build professional websites, but we can't promise customers, sales, revenue, search rankings, or traffic. Those depend on many things we don't control.
10.2 Limits. To the fullest extent the law allows, ZwanZ isn't liable for indirect or consequential damages, including lost profits, lost business, or lost data. Our total liability for any claim related to our services is limited to the amount you paid us in the 12 months before the claim.
10.3 What this doesn't change. Nothing in these terms limits any right or liability that the law doesn't allow us to limit.
You can end it at any time by cancelling hosting (section 5) and, before we start work, by requesting a refund (section 6). We may end it if you don't pay, break these terms, misuse the service, or if we reasonably can't deliver what you need. If we end it for a reason other than your breach, we'll refund fees as described in section 6.
We collect the information you give us at checkout and in your intake form to build and run your site. Payments are processed by Stripe, and we never see or store your full card number. Our Privacy Policy explains how we handle your information. We may email or text you about your project, and you can reply STOP to opt out of texts.
These terms are governed by the laws of the State of Florida. Please contact us first at zwanz@zwanz.com so we can try to resolve any issue informally. If we can't, disputes will be handled in the state or federal courts located in Miami-Dade County, Florida.
We may update these terms from time to time. The effective date above shows the latest version. If we make a material change that affects your hosting plan, we'll email you at least 30 days before it applies, and you can cancel before then.
These terms, together with your checkout, your intake form, and our Privacy Policy, are the whole agreement between you and ZwanZ for these services. If part of it can't be enforced, the rest still applies. If we don't enforce a term right away, that doesn't mean we've given it up. You may not transfer your rights under these terms without our consent. By completing checkout, you confirm you're authorized to buy for your business and agree to these terms electronically.
